This gate when held at a 90 degree angle only provides 1 inch underneath due to parking lot topography. that Public swimming pool fences constructed prior to May 1, 2010 may vary from the provisions of Paragraph (a) of
this Rule as follows: the maximum vertical clearance between grade and the bottom of the barrier may exceed two inches,
but shall not exceed four inches;
(2) where the barrier is composed of vertical and horizontal members and the space between vertical
members exceeds 1.75 inches, the distance between the tops of the bottom horizontal member and
the next higher horizontal member may be less than 45 inches, but shall not be less than 30 inches;
(3) gates other than pedestrian access gates are not required to have self-latching devices if the gates
are kept locked; and
(4) gates may swing towards a pool where natural topography, landscape position or emergency egress

The CPO (Will Stewart) who was present at the time of inspection could not provide a legible copy of his national CPO certification. EHS contacted Jessica Sanders and Jessica stated that the certifications of Andrew Kearns would be sufficient information to issue the permit.
The gate that leads to the upstairs balcony does not meet the current fence rules. Then gate can function properly as a gate but is supposed to be locked at all times. There are signs that further inform that this gate is not in use. This gate should still be upgraded to meet the current rules. When the distance between two cross members is less than 45" the opening between the vertical member's or otherwise may not be more than 1.75". Upgrade the gate in a similar fashion to the lower gate.
